EU Member Relative Residence Permit


Procedure

  1. Analysis of case – Our specialised lawyers will analyse individually the case and will comment on the most important aspects concerning this type of residency, in particular to do with the gathering of the documentation.
  2. Preparation of case : Once the necessary documentation has been gathered, the file will be forwarded to the application for presentation in the Consulate.
  3. Submission of the application for residency permit in the Consulate.
  4. Study of the application and grant of visa: The Consul, upon completing the analysis of the documentation, will grant a residency visa of family member of national of a country member of the UE or EEE. The Consul may decide on the convenience of a personal interview with the applicant and equally, at his discretion, may request the submission of a medical certificate in conformity with the International Sanitary Regulations as well as a criminal record certificate.
  5. Travel to Spain and submission of application for residency card : Within 1 month from arriving in Spain the applicant will have to submit, in the Foreigners department of the province where he wishes to reside, the application for the residency card.
  6. Visa exemption : The requirement of a visa is not necessary in a number of cases, in particular for a foreign national spouse of a Spanish national or a national of a member state of the UE or EEE resident in Spain, provided they are not separated.

Duration of the process

Pursuant to Royal Decree 178/2003, the application for the residency card will be processed with preference over other applications and should be resolved within 3 months from the date of submmision stamped on the application in the entry registry of the Government office in charge of processing.

Thanks to Lawbird we recovered our money from the sale of our apartment in Spain. We sold our apartment in May 2008. We were told by the lawyer representing us during the sale that it would normally take 2-3 months to receive our money. This is rubbish and beware of any Spanish lawyers that sell you this line or jargon.

In January 2009 with still no money from the sale of our property and countless emails and phone calls later we decided to take further action.
